This section constitutes the ToU for the website. It aims to define the terms and conditions of use for the site by the user. The user is deemed to have read and accepted the ToU.

1 - COPYRIGHT AND TRADEMARK RIGHTS

The website is an intellectual creation under the applicable provisions of the French Intellectual Property Code. Each customer, prospect, or partner has a personal, non-exclusive, non-transferable right to access the information on the site for their own needs related to hotel reservations.

They are allowed to extract and/or reuse part of the site’s content for personal consultation purposes, provided that this extraction and/or reuse does not concern a substantial part of the site’s content, whether qualitative or quantitative. Additionally, repeated extraction and/or reuse of even non-substantial content is prohibited.

1 - Preamble

OVYO is committed to ensuring that the collection and processing of your data is carried out in a lawful, fair, and transparent manner, in accordance with the General Data Protection Regulation (GDPR) and Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms.

2 - Nature of Data Collected

We may collect information about you and/or your accompanying guests, including the following:

  • Contact details (e.g., last name, first name, phone number, email)
  • Personal information (e.g., date of birth, nationality)
  • Information about your children (e.g., first name, date of birth, age)
  • Your credit card number (for transaction and reservation purposes)
  • Information on an identity document (e.g., identity card, passport, or driver’s license)
  • Your arrival and departure dates
  • Your preferences and interests (e.g., smoking or non-smoking room, preferred floor, type of bedding, types of newspapers/magazines, sports and cultural interests, food and drink preferences, etc.)
  • Your questions/comments during or after your stay
  • Technical and location data generated while using our websites and applications
  • Information collected regarding individuals under the age of 18 is limited to their name, nationality, and date of birth, which can only be provided by an adult. We kindly request that you ensure your children do not send us any personal data without your consent (especially via the internet). If such data is sent, you may contact OVYO to request the deletion of this information.
3 - When Your Data is Collected

Generally, we collect personal data directly from you at the time of booking, whether done remotely online or in person. Providing this information is voluntary, unless we notify you that it is mandatory, for example, because it is necessary to book your hotel room. In such cases, if you do not provide the information, we may be unable to fulfill your request, such as processing a reservation. Personal data may be collected on various occasions, including: room booking, check-in and payment, requests, complaints, and/or disputes, participation in services offered by OVYO, membership in loyalty programs, and the transmission of information by third parties, such as tour operators, travel agencies (online or offline), GDS reservation systems, and others (e.g., transmission of information by third parties necessary to process your booking request, such as tour operators).

4 - Access and Disclosure of Your Personal Data

Your data is used to improve service quality and your experience. We share your data with several authorized individuals and departments within HOTEL CASSEHGARI SAS to provide you with the best experience at our establishments. The following teams may have access to your data: Hotel staff, reservation staff using booking tools, IT departments, marketing teams, legal services if applicable, and, in general, any relevant personnel within OVYO entities for certain specific categories of personal data.

5 - Security of Your Personal Data

OVYO takes appropriate technical and organizational measures, in accordance with applicable legal provisions, to protect your personal data from unlawful or accidental destruction, alteration, or loss, as well as from misuse and unauthorized access, modification, or disclosure. To this end, we have implemented technical measures (such as firewalls) and organizational measures (such as an identification/password system, physical protection measures, etc.) to ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems and services. Regarding the submission of credit card data during booking, SSL (Secure Socket Layer) encryption technology is used to ensure a secure transaction. Organizational measures ensure secure processing.

The OVYO website may place cookies on your device. The cookie records information related to browsing on the service:

  • The date and time of the visit
  • Information about access frequency
  • Personalization of pages, as well as actions performed and information viewed

7 - Your Rights

You have the right to obtain information about your personal data collected by OVYO and to access it, subject to applicable legal provisions. You also have the right to rectify, erase, or restrict the processing of your personal data. Additionally, you can exercise your rights regarding your stored and processed personal data, as the data controller.

Please contact OVYO by writing to contact@ovyo-hotel.com. All requests will be responded to as soon as possible. For privacy and personal data protection reasons, we will need to verify your identity before responding to your request. In cases of reasonable doubt about your identity, you may be asked to include a copy of an official identity document, such as an identity card or passport, with your request. A black-and-white copy of the relevant page of your ID document is sufficient.

Terms of Sale and Rates
Guarantee Policy

The total amount for the stay is payable in advance by credit card at the time of booking.

Cancellation Policy

The amount paid is refundable in case of cancellation up to 48 hours before the start of the stay. After this period, the amount is non-refundable.

Check-in Policy

The room is available from 4 PM. Contact the reception to schedule an early check-in for an additional 10 euros.

Check-out Policy

The room must be vacated by 11 AM on weekdays and by 12 PM on weekends. Contact the reception to schedule a late check-out for an additional 10 euros.

Child Policy

Accommodation and breakfast are free for 1 child (or multiple children) aged between 3 and 12 years, staying in their parents' room using the existing bedding, with breakfast shared as a family. For babies under 3 years, a baby cot is available for 7 euros and breakfast is free.

Accommodation price per night for a double room accommodating 1 to 2 people: Between 110 € and 150 € (Taxes and fees included)

Accommodation price per night for a family room accommodating 2 to 4 people: Between 130 € and 200 € (Taxes and fees included)

General Terms Applicable to Services

OVYO operates the website https://ovyo-hotel.com/ (hereinafter referred to as the "Site"). The Site allows for the booking of rooms (and additional services) in its hotel or other types of accommodation operated under the "OVYO" brand (hereinafter referred to collectively as the "Establishments"). It should be noted that all messages transmitted via the Site may be intercepted and that their confidentiality cannot be guaranteed until they have reached us.

1 - Preamble

These general terms (the "Terms") define the clauses and conditions under which Ennismore allows its customers (the "Client(s)") to benefit from all services, and in particular, the reservation services available on this Site, described below (collectively referred to as the "Services"). Before making any reservation for a Service on the Site, the Client declares: that they are acting in a personal capacity and not within the scope of a commercial activity; and that they are at least 18 years old and have full legal capacity to accept these Terms. The Client is asked to carefully review these Terms, which must be accepted before reserving any Service offered on the Site. OVYO reserves the right to modify or supplement any part of these Terms at any time. In such cases, the new version of the Terms will be made available on the Site as of its effective date. Clients are encouraged to regularly check the Terms to stay informed of any changes. In any case, the Client will only be bound by the version of the Terms in effect at the time they made the reservation for the Service. The Client is responsible for paying for the necessary technical means to access the Site.

2 - Description of Services

OVYO offers reservation services for hotel rooms or other types of accommodation ("Accommodation Services") and additional services related to these Accommodation Services ("Additional Services") on its Site. The Accommodation Services and Additional Services are collectively referred to as "OVYO Services".

Accommodation Services - The key features, availability dates, prices, available options, payment terms, and specific sales conditions applicable to the selected rate (guarantee policies, cancellation conditions, check-in dates, member rate terms, check-in and check-out times, guarantee policy, cancellation period, Wi-Fi access, special terms for children, and whether pets (except for service animals) are allowed in the Establishment, etc.) are presented during the reservation process described in clause 3 below.

Additional Services - Additional Services include travel services as defined in Article 3.1 of Directive (EU) 2015/2302 of November 25, 2015, on package travel and linked travel arrangements, which, along with Accommodation Services, may constitute a "linked travel arrangement" or a "package holiday" according to the criteria mentioned in the aforementioned directive. This information is provided to the Client before booking these services under the conditions applicable to each offer. The Site may also allow the reservation of other types of Additional Services, such as breakfast, a bottle of champagne upon arrival, a sports activity, or a spa treatment, subject to the applicable conditions defined by OVYO.

Partner Services - OVYO enters into partnership and distribution agreements with third-party websites (the "Partners") to allow the Client to search, select, and book rooms in its establishment through the Partner's website (the "Partner Services"). Bookings made by the Client through Partner Services are carried out via each Partner's website and mobile services. The booking is made directly between the Client and the Partners, following the steps outlined on the Partner's website and mobile services. The sales terms and conditions applicable to these Partner Services are available on the Partner's website. For the purposes of these Terms, Partners include Booking.com and Expedia.

3 - Reservation Process

The Client selects any Service presented on the Site or on the Partner websites by following the designated process. OVYO Services reservations can be made by the Client either on the Site or in person on-site. The reservation process varies depending on the Client's journey and request and includes the following steps:

Step 1 - Entering the details and features of the selected Service(s), particularly in the case of an Accommodation Service: Accommodation features, length of stay, available options, total reservation price including applicable taxes, legal information form in the case of linked travel services or package holidays, as well as any applicable Special Terms (guarantee policies, cancellation policies, check-in time, etc.).

Step 2 - Summary of the Service reservation, including key features (length of stay, OVYO Service features, total amount including taxes); and providing the Client's contact information by filling in all mandatory fields (indicated by an asterisk) or through membership in OVYO's loyalty program (if applicable).

Step 3 - Reservation of the Service by the Client with confirmation of the selected rate for the Service; entering payment information, whether for prepayment of all or part of the reservation price before the stay, or for securing the reservation with OVYO Service; and reviewing and accepting the Terms and Special Conditions of the reservation before validation by the Client.

Step 4 - Acceptance of the Service reservation by Ennismore and the relevant Establishment.

Step 5 - Sending the Client a confirmation email summarizing the reserved Service(s), price(s), Special Conditions accepted by the Client, date of the reservation, after-sales service information, and the Establishment's address where the Client can submit any complaints.

The Client may book services on behalf of one or more additional persons for up to a maximum of 4 (four) rooms. Beyond this number, the Client's reservation will be subject to the conditions applicable to group bookings.

All reservations are considered confirmed once the Client receives a confirmation page and/or a confirmation email.

4 - Prices

The prices for booking Services are indicated before, during, and after the reservation. For Accommodation Services, the prices shown are for a room based on the number of people and the selected date. When confirming the reservation of a Service, the total price is displayed to the Client in euros, including all applicable taxes, and is valid once the reservation is finalized. Unless otherwise indicated on the Site, options (e.g., breakfast, parking, baby cot, etc.) not offered during the Service reservation are not included in the price. The tourist tax, announced during the Service reservation process, must be paid directly at the Establishment unless it has been prepaid online before the stay. The prices take into account the applicable taxes at the time of booking; any changes in applicable taxes are automatically reflected in the price at the billing date. Any change or introduction of new legal or regulatory taxes by the relevant authorities will automatically be added to the price on the billing date. Some promotional offers are only available on the Site and are exclusively sold online; they are not available at the Establishment's reception. In general, the prices displayed on the Site are based on real-time pricing. They may vary depending on the booking period (advance booking or closer to the stay), the dates of stay (weekdays/weekends, season, school holidays, public holidays, events, etc.), demand, or other factors such as geopolitical, climatic, or economic conditions. For promotional offers, the promotions displayed apply to the standard daily rate offered by the Establishment, which would have applied in the absence of the promotion.

5 - Payment

The Client provides their payment information to either prepay for the reservation before the stay or to secure the reservation. By directly providing the following details at the designated place (secured by 3D Secure encryption) for payment by credit card: card number (without spaces), expiration date (the card must be valid on the stay date), and the security code for advance payment. The Client's credit card validity is verified by OVYO's partners, and the card may be declined for various reasons: theft or blockage, credit limit reached, data entry error, etc. In case of any issue, the Client must contact their bank, the Establishment, or another relevant entity to confirm the reservation and payment method. The online payment methods available on the Site's payment page may include Visa, Mastercard, and American Express. This list is subject to change.

The Establishment may also ask the Client to present identification to prevent credit card fraud. If the Client has not prepaid online for their stay, the Establishment may request a deposit or authorize a credit card charge upon arrival to guarantee payment for on-site services. If the Client does not arrive on the first day of their Accommodation Service reservation (no-show), the reservation will be fully canceled. The Client is informed that, in such cases, the Establishment will release the rooms for resale, and if the reservation is non-refundable, non-changeable, or non-cancelable, the Client will not be entitled to any refund or compensation. If the reservation is guaranteed by credit card or has been pre-authorized by the bank, the Establishment will charge the cost of the first night's stay to the card provided for the reservation, and all other nights will be canceled free of charge unless stated otherwise in the Special Conditions.

An electronic invoice will be sent to the Client's email address provided at the time of booking; if the Client prefers to receive a paper invoice, they must make an express request to the relevant Establishment.

Advance Payment - At the time of advance payment, the amount charged for the Service reservation includes the total amount indicated at the booking date (including all applicable taxes) and, if applicable, the price of the selected options as described in clause 4 above. A certain delay may be required to charge the reservation amount. If, after this period, the reservation amount has not been charged, the reservation will be canceled.

6 - Credit Card Guarantee

Guaranteeing the reservation by credit card requires the Client's payment details to be entered at the time of booking. No amount is charged to the Client's credit card, and the cost of the stay is paid directly at the Establishment on the day of arrival or departure, except in cases where the Client does not show up at the Establishment without prior cancellation according to the cancellation conditions corresponding to the agreed rate.

7 - Pre-Authorization

If the Client has not prepaid online for their stay, the Establishment may, on the day of arrival, request a pre-authorization from the Client's bank on the credit card, up to an amount equal to the total reservation price plus a fixed amount to cover any services or expenses incurred during the stay (breakfast if not included in the rate, restaurant, bar, tourist tax if applicable, etc.). This fixed amount is determined by the Establishment based on the number of people and the number of nights reserved.

This pre-authorization request does not correspond to an immediate charge but serves as a provision for future payments, authorized by the Client's bank and temporarily reducing the credit card limit to allow for future charges. In some cases, depending on the Client's bank, the pre-authorization request may appear as a pending charge on the bank account linked to the credit card used. Once the pre-authorization request has been activated and confirmed by the bank, two scenarios may occur:

1. The Client arrives at the Establishment, the full payment for the stay is made directly at check-in or check-out. The Establishment then cancels the pre-authorization request with the Client's bank. All services consumed and expenses incurred on-site by the Client must be settled upon departure.

2. The Client does not arrive at the Establishment on the first day of the reservation, in which case the Establishment will request a debit from their bank. In rare cases, the pre-authorization request may result in a charge by the Client's bank before the actual charge is processed. In such cases, any double charges will be avoided, and any remaining balance owed to the Client will be automatically credited to their account by their bank.

In the event of a reservation cancellation after the pre-authorization request has been activated, in accordance with the cancellation conditions, a cancellation request for the pre-authorization will be automatically sent to the cardholder's bank. In rare cases, this cancellation may be presented as a refund. Please note that 24 to 48 hours are usually required to release the pre-authorized amount (or issue a refund), but this period can extend to 7 business days or more, depending on the cardholder's bank.

To enable the pre-authorization request, the Client must provide their credit card details as part of the reservation guarantee. The Client is informed in advance of the characteristics of the pre-authorization request. Credit card data is only stored by OVYO's payment service provider, in compliance with a strict banking data security policy.

8 - Client No-Show

If the Client does not show up on the first day of the OVYO Service reservation (no-show), their reservation will be fully canceled, and if the reservation is non-cancelable, non-changeable, and/or non-refundable, the Establishment will retain, as a deposit under Articles 1590 of the Civil Code and L 214-1 of the Consumer Code (in their applicable versions at the time), the total amount paid by the Client during the reservation. If the reservation is cancelable, changeable, and/or refundable and guaranteed by credit card, the Establishment will charge the non-refundable amount to the credit card provided during the reservation. For Accommodation Services, this amount will include the charges for the first reserved night (plus taxes), with the remaining nights being canceled without additional charges. The Client is informed that, in such cases, the Establishment will release the rooms for resale. The Client will not be entitled to any refund or compensation. If the Client has prepaid for a non-cancelable, non-changeable, or non-refundable reservation, the deposit charged will include the total amount indicated during the reservation and, if applicable, the price of any selected options as stated in clause 4 above.

9 - Cancellation or Modification of a Service Reservation

For Accommodation Services, please note that consumer law provides an exception to the general right of withdrawal or cancellation for contracts related to the provision of Accommodation Services on a specified date or period. For each Service reservation, the Special Conditions outline the conditions for cancellation and/or modification of the reservation. Prepaid reservations cannot be canceled but may be modified to change the stay dates, possibly resulting in an updated nightly rate based on the new stay period. Deposits (advance payments) will not be refunded. This provision is included in the Special Conditions. When the Special Conditions allow: cancellation and modification of a Service reservation can be made directly with the Establishment, whose contact details, including the phone number, are provided in the reservation confirmation email. If the Client interrupts a Service, the full agreed price will be charged. No refund will be granted for reservations with prepayment made before the stay. For Accommodation Services, unless otherwise stated in the Special Conditions, the Client must vacate the room before the time indicated by the Establishment, generally at noon on the last day of the reservation. Failure to do so may result in an additional night being charged.

10 - Obligations and Responsibilities of the Client

The Client is solely responsible for selecting the Services on the Site and ensuring they meet their needs, and OVYO cannot be held liable in this regard. The Client is also solely responsible for the information provided when reserving a Service. OVYO cannot be held responsible for any incorrect or fraudulent information provided by the Client. Furthermore, the Client is solely responsible for all reservations made, both for themselves and for others, including minors, unless they can demonstrate that fraudulent use occurred without their fault or negligence. In this regard, the Client must immediately inform OVYO of any hacking or fraudulent use of their email address by contacting customer service, whose contact details are provided in clause 10.

The Client agrees to use the Site and the Services offered in compliance with the applicable regulations and these Terms. In the event of a breach of the obligations imposed on the Client by these Terms, the Client will be liable for all damages caused to OVYO or third parties. In this regard, the Client indemnifies and holds OVYO harmless from any claims, actions, or legal proceedings of any kind and agrees to compensate OVYO for any damages, fees, or compensation related thereto. The Client agrees to honor the finality of their Service reservation, pay the price, and comply with the Special Conditions attached to it.

Subject to the Special Conditions: any irregular, unsuccessful, incomplete, or fraudulent reservation or payment for a reason attributable to the Client will result in the cancellation of the Service reservation at the Client's expense; the Client is prohibited from inviting anyone to the Establishment whose behavior may cause inconvenience to the Establishment and/or other guests; the Client is prohibited from smoking in the rooms and within the Establishment. An outdoor smoking area is provided at the Establishment; the Client is prohibited from disrupting the operation of the Establishment, interfering with it, and in particular from hindering the work of its staff or compromising the safety of the Establishment or the people within it. More generally, any behavior contrary to good morals and public order within the Establishment, as well as any violation of the Establishment's Internal Regulations, may lead the Establishment's Director and/or any other service provider to ask the Client to leave without compensation and/or refund if payment has already been made. If no payment has been made, the Client must settle the price of the Services consumed before leaving; any minor must be accompanied by an adult and possess personal identification; this adult must have the consent of the parents (the Establishment may request proof of parental consent); and the Client also agrees to ensure that the computer equipment provided by the Establishment (including the Wi-Fi network) is not used to reproduce, represent, make available, or communicate to the public works or objects protected by copyright or neighboring intellectual property rights, particularly texts, images, photographs, musical or audiovisual works, software, and video games without the authorization of the rights holders as provided for in Books I and II of the Intellectual Property Code, where such authorization is required. The Client is also required to comply with the security policy of the Establishment's internet service provider, including the guidelines providing for security measures implemented to prevent any unlawful use of resources and to avoid any actions that may compromise the effectiveness of these measures. The Client will be liable for any damages caused by themselves and/or their guests within the Establishment and will bear all costs resulting from such damages and/or any failure to comply with the above rules. OVYO reserves the right to intervene if necessary and to take appropriate measures regarding the Client.

11 - Obligations and Responsibilities of OVYO

OVYO agrees, under a best-effort obligation, to provide access to the Site and the Services offered in accordance with the Terms, to act diligently and competently, and to make all reasonable efforts to address any malfunctions brought to its attention. However, OVYO may be forced to temporarily suspend the Site without notice, particularly for technical reasons related to maintenance, without incurring any liability. The Client acknowledges and accepts that OVYO cannot be held responsible for any inconvenience or damage resulting from the use of the internet, including, without limitation: poor transmission and/or reception of any data and/or information over the internet; failure of any receiving equipment or communication line; and any malfunction of the internet network preventing the Site from functioning correctly and/or recording Service reservations. The Site may direct users to links to other websites published and managed by third parties, for which OVYO cannot be held responsible for the content of these websites or the services they offer. In this regard, it should be noted that partners are responsible for promoting the offers published on their websites. Therefore, the Client is solely responsible for their decision to consult third-party websites. The Client acknowledges and accepts that in the event of a dispute related to a stay at an Establishment or the reservation of an OVYO Service, they agree to contact the company.

12 - Dispute Resolution

After contacting Customer Service or the Establishment to attempt to resolve the dispute amicably, if no response or a negative response is received within sixty (60) days of such contact, the Client may refer the matter to the Tourism and Travel Mediator – BP 80303 – 75823 Paris Cedex 17.
